Terms of Service

Empire Marketing LLC, a New Mexico-registered limited liability company (407 Lincoln Road, Suite 708, Miami Beach, FL 33139, USA), operates 0xLists (“the Service”). By creating an account or using the Service you agree to these Terms.

1. Service description

0xLists provides multi-tenant Telegram promotion bot infrastructure: bot deployment, channel discovery, bracket sorting, and scheduled cross-promotion. You connect your own Telegram bot tokens and channels; we run the dispatching, scheduling, and database.

0xLists is a neutral, passive infrastructure provider. We are not a publisher, editor, or curator of your content: we do not create, select, endorse, monitor, or control the channels, groups, links, or destinations that appear in your lists. All such content originates from you and the third parties you choose to admit.

2. Account responsibility

  • You are responsible for the content posted by your bots into your Telegram channels.
  • You are responsible for every channel, group, link, and destination included in your lists, and for the conduct of any third party whose content you admit or promote.
  • You represent and warrant that you have all rights necessary to publish the content, links, and destinations you connect, and that doing so does not violate any law or the rights of any third party.
  • You must keep your account credentials confidential. Activity performed via your account is your responsibility.
  • You must provide accurate signup info. Fake or fraudulent accounts may be terminated without refund.

3. Acceptable use

You may not use the Service to:

  • Distribute spam, malware, phishing, or scam content.
  • Violate copyright, trademark, or other intellectual property.
  • Distribute content illegal in your jurisdiction or in the United States (New Mexico).
  • Impersonate another person or entity, or misrepresent your affiliation.
  • Circumvent rate limits, anti-fraud controls, or platform fees.
  • Use the affiliate program to refer yourself or generate fraudulent referrals.

These examples are not exhaustive. Our full Acceptable Use Policy forms part of these Terms and governs what you may and may not do with the Service.

4. Illegal content & child safety

You may not store, distribute, promote, or link to content that is illegal under United States federal law, the law of the State of New Mexico, or the law of your own jurisdiction. We maintain a zero-tolerance policy toward child sexual abuse material (CSAM) and any content that sexualizes, exploits, or endangers a minor, as well as content that promotes terrorism, violent extremism, or human trafficking.

We do not proactively monitor the channels, groups, links, or destinations you connect. When we become aware of such content — whether through a report or otherwise — we will act: we may preserve the material and associated records, remove or disable access, suspend or terminate the account, and report to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law. We cooperate with valid legal process. Report concerns to [email protected].

5. Copyright (DMCA)

0xLists respects intellectual-property rights and responds to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act. If you believe material accessible through the Service infringes your copyright, send a notice to [email protected]. Repeat infringers' accounts are terminated. See our full Copyright Policy (DMCA) for notice and counter-notice requirements and our Designated Agent.

6. Subscription & billing

  • Subscriptions are billed monthly via Stripe (card) or NowPayments (USDT/USDC). Prices are in USD.
  • The Free plan needs no card. A 14-day Pro trial (once per account, no card) starts when you first use a premium feature; when it ends, your bot drops back to the Free plan — it keeps running unless you subscribe.
  • You may cancel anytime; the subscription remains active until the end of the paid period.
  • All sales are final. Cancelling stops future charges; charges already made are not refunded. Crypto payments (USDT/USDC) are non-reversible.

7. Affiliate program

Our affiliate program pays 20% lifetime commission on referred paying customers. Full terms in your affiliate dashboard. The program is not available to US-resident affiliates due to compliance overhead. Self-referrals are blocked. Fraudulent referrals void all earned commissions.

8. Data

We store your bot configuration, channel list, payment history, and usage logs. We do not sell or share this data with third parties for marketing. On account deletion, data is purged within 30 days. Bot tokens are encrypted at rest with rotating keys. See the Privacy Policy for details.

9. Termination

We may suspend or terminate accounts that violate these Terms, engage in fraud, or pose risk to other users. We may also discontinue the Service with 30 days' notice to active subscribers, refunding unused prepaid time pro-rata.

10. Limitation of liability

The Service is provided “as is” without warranties. Empire Marketing LLC is not liable for: lost revenue, lost data, downtime caused by Telegram, Stripe, NowPayments, or any third-party service, account suspensions imposed by Telegram on your bots, or indirect/consequential damages. Our total liability is capped at the amount you paid us in the prior 3 months.

11. Indemnification

You agree to indemnify, defend, and hold harmless Empire Marketing LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) the content you or your bots publish, or the channels, groups, links, or destinations you connect; (c) your violation of these Terms, the Acceptable Use Policy, or any applicable law; or (d) your infringement of any third-party right.

12. Governing law

These Terms are governed by the laws of the State of New Mexico, USA. Any dispute will be resolved in the state or federal courts located in New Mexico.

13. Changes to these terms

We may update these Terms; substantial changes will be notified by email at least 14 days before taking effect.
